South Big Horn Senior Citizens, Inc. is committed to ensuring that no person is excluded from participation in, or denied the benefits of, or be subject to discrimination in the receipt of its services on the basis of race, color, or national origin, or any other characteristics protected by law, including Title VI of the Civil Rights Act of 1964, as amended. Further, under the Americans with Disabilities Act (ADA) of 1990, no entity shall discriminate against an individual with a physical or mental disability in connection with the provision of transportation service.

You may file a written complaint no later than 180 calendar days after the date of the alleged discrimination.

If an individual feels that they have been denied transportation unfairly, they may follow the grievance procedure outlined in the South Big Horn Senior Citizens Guidelines.  Copies of the grievance procedure are available at the front desk during business hours.

Policy Manual: Grievances and Appeals

Any person aged sixty (60) years or above and residing in the service area of SBHSC, who feels that they have been unfairly denied services shall have the right to be heard by the Board of Directors.

The Grievant shall send to the Chairman of the Board of Directors a written request for hearing before the Board of Directors within seven (7) calendar days after receipt of the written request for hearing.  The Grievant shall be notified in writing of the time and place of the hearing.

A hearing before the Board of Directors shall be scheduled as soon as is practical, but no later than fourteen (14) calendar days after receipt of the written request for hearing.

During a grievance hearing, the Grievant shall have the right to be represented by counsel or other representative of his or her choosing, to call witnesses, and to present evidence.  The Grievant and any witness, upon completion of testimony and/or presentation of evidence, shall be subject to examination by members of the Board of Directors and/or their counsel or representative.  The Board shall, at the completion of presentation of the Grievant evidence, present evidence on behalf of SBHSC, including all evidence and complaints upon which was based the denial of services to the Grievant.  The Grievant and/or his counsel or representative shall then have the right to question any evidence presented by and/or any witness giving testimony on behalf of SBHSC or making complaint against the Grievant.

Any Grievance Hearing shall be presided over by the Chairman of the Board of directors or other designated member of the Board, who shall conduct said hearing in a fair and orderly manner.  The hearing shall be private; attended by members of the Board, the Board’s counsel or representative, SBHSC personnel involved and/or called as a witness, the Grievant, his or her counsel or representative, and all witnesses.
